Welcome to artisanthegoat.com (the "Site"), operated by Artisan The Goat ("We," "Us," or "Our"). By accessing or using the Site, purchasing products, creating an account, or interacting with our content, you ("You" or "User") agree to be bound by these Terms of Use ("Terms"). Please read them carefully. If you do not agree to these Terms, please do not use the Site.

These Terms include an arbitration agreement and class action waiver in Section 16 that affect your legal rights. Please read those sections carefully.

1. Who We Are

Artisan The Goat is a family-owned organic goat milk skincare, body care, soap, lip balm, and beeswax candle company operating from our Washington State farm. Our products are formulated and manufactured on-site, and we ship across the United States from the rural Battle Ground, Washington area.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make purchases on the Site or create an account. By using the Site, you represent and warrant that you meet this requirement and that you have the legal authority to enter into these Terms.

3. Your Account

If you create an account on the Site, you are responsible for providing accurate and complete information, maintaining the confidentiality of your password and account credentials, all activity that occurs under your account, and notifying us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our discretion, including for any violation of these Terms.

4. Orders, Pricing, and Payment

All orders placed on the Site are offers to purchase, and are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to suspected fraud, pricing errors, or unavailability.

All prices are displayed in U.S. dollars and are subject to change without notice. Despite our efforts, pricing errors may occur. If a pricing error is discovered, we reserve the right to cancel the affected order and refund any amount charged.

Payment is processed through our payment processors. By submitting payment information, you represent that you are authorized to use the payment method. Applicable sales taxes will be added at checkout based on your shipping address.

5. Shipping, Returns, and Refunds

Shipping options, costs, and timeframes are described at checkout. We are not responsible for delays caused by shipping carriers, weather, or events outside of our control. For information about our return and refund policies, please see our Refund Policy.

6. Product Information and No Medical Claims

We make and sell skincare, body care, soap, lip balm, and candle products. We do our best to describe our products and their ingredients accurately, but we cannot guarantee that every description is complete or error-free, and we do not guarantee specific results from any product. Skin and individual reactions vary.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. If you have a medical condition, allergy, are pregnant, or are otherwise unsure whether one of our products is right for you, please consult a qualified healthcare professional before use, and always spot-test a small area first.

7. Intellectual Property

All content on the Site — including text, photographs, videos, graphics, logos, product names, formulations, the "Artisan The Goat" name and mark, and the design and layout of the Site — is owned by Artisan The Goat or our licensors and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our material, except as follows. You may temporarily store copies on your device while viewing the Site in the ordinary course of your visit. You may print or download a reasonable number of copies of pages for your own personal, non-commercial use, provided that you do not modify the content and you keep all copyright and proprietary notices intact. You may also share publicly posted social media content on its native platform, in accordance with that platform's terms.

You may not use any "Artisan The Goat" mark, logo, photograph, or product name in connection with any product or service that is not ours, in any manner that is likely to cause confusion, or in any manner that disparages or discredits us.

8. User Conduct

When you use the Site, you agree not to violate any applicable law, regulation, or third-party right, and not to attempt to gain unauthorized access to any part of the Site, our servers, or our systems. You agree not to introduce viruses, malware, or other harmful code to the Site, and not to interfere with or disrupt the Site or the servers and networks connected to it. You agree not to use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission, and not to frame, mirror, or otherwise reproduce any part of the Site without our permission. You agree not to use the Site to send unsolicited commercial communications, and not to impersonate any person or entity, including any of our family members or team members. Finally, you agree not to post or submit content that is unlawful, infringing, defamatory, obscene, harassing, threatening, or otherwise objectionable, and not to make false or misleading statements about our products, our family, or our farm.

9. User-Generated Content

If you submit reviews, photos, videos, comments, social media posts that tag us, or other content related to Artisan The Goat ("User Content"), you agree to our User Generated Content Permission Terms.

In short: you retain ownership of your User Content, but you grant us a broad license to use it to promote our family business across our website, social media platforms, email marketing, and advertising. Full details are in the User Generated Content Permission Terms.

10. Third-Party Links and Services

The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Artisan The Goat. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your use of any third-party website, application, or service is governed by that third party's terms and privacy policy.

11. Reviews and Testimonials

We may display product reviews and customer testimonials on the Site. Reviews and testimonials reflect the personal experiences of individual customers, are not medical advice, and may not be representative of the results you will experience. We reserve the right to moderate, edit for length or clarity, or decline to publish any review for any reason consistent with applicable law.

12. Promotions, Giveaways, and Discounts

From time to time we may run promotions, giveaways, or offer discount codes. These are subject to additional terms posted with the promotion. Unless otherwise stated, discount codes are limited to one use per customer, cannot be combined with other offers, and may be modified or terminated at any time.

13. Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION ON THE SITE.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARTISAN THE GOAT, ITS OWNERS, FAMILY MEMBERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless Artisan The Goat, its owners, family members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your violation of any law or third-party right, your User Content, or your misuse of the Site or any product purchased from us.

16. Mutual Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

You and Artisan The Goat agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased from us — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — will be resolved by final and binding individual arbitration, rather than in court, except as provided below.

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted by a single arbitrator. The arbitration will take place by remote electronic means where permitted; if an in-person hearing is required and the parties cannot agree on a location, it will take place in a metropolitan area within 100 miles of Vancouver, Washington. The Federal Arbitration Act (9 U.S.C. §§ 1-16) governs this arbitration agreement.

Class Action Waiver. You and Artisan The Goat agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, consolidated, or private attorney general action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions. Either party may bring an individual action in small claims court if eligible. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights.

Opt-Out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out by email to hello@artisanthegoat.com with the subject line "Arbitration Opt-Out" within thirty (30) days after first becoming subject to these Terms. Your notice must include your full name, mailing address, and a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms.

If the Class Action Waiver is found to be unenforceable for any reason with respect to a particular claim, then that claim (and only that claim) must be severed and brought in a court of competent jurisdiction in the State of Washington, but the remainder of the arbitration agreement will continue to apply.

17. Governing Law and Venue

These Terms and any dispute between you and Artisan The Goat are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Subject to Section 16, you and Artisan The Goat agree that the state and federal courts located in Clark County, Washington shall have exclusive jurisdiction over any claim that is not subject to arbitration.

18. Termination

We reserve the right to suspend or terminate your access to the Site, or to refuse service, at any time and for any reason, with or without notice. Sections that by their nature should survive termination (including without limitation Sections 7, 8, 13, 14, 15, 16, 17, and 19) will survive any termination of these Terms.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a revised effective date. If we make material changes, we will provide additional notice (such as a banner on the Site or by email to registered customers). Your continued use of the Site after the updated Terms take effect constitutes your acceptance of the updated Terms.

20. Miscellaneous

These Terms, together with the other policies linked from the Site footer, constitute the entire agreement between you and Artisan The Goat regarding the Site, superseding any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign these Terms freely. Headings are for convenience only and do not affect the interpretation of these Terms.
