This Consumer Health Data Notice ("Notice") applies to "Consumer Health Data" that Artisan The Goat ("We," "Us," or "Our") collects about residents of the State of Washington (and, where applicable, residents of Nevada and Connecticut) in connection with their use of our website at artisanthegoat.com, our products, our farmers market booth, and other interactions with our small family business.
This Notice supplements our Privacy Policy and is provided in compliance with the Washington My Health My Data Act (RCW 19.373) and similar state laws regulating consumer health data.
We are a small family-owned skincare and body care business operating from our Washington State farm. We do not seek out or sell sensitive medical information. We may collect the following limited categories of Consumer Health Data, only as necessary to operate our business, process orders, respond to customer questions, and improve our products:
- Skin and body care concerns voluntarily shared by you. This includes information you choose to provide in customer service emails, product reviews, contact forms, social media messages, or in person at our farmers market booth — for example, that you have sensitive skin, dry skin, eczema-prone skin, joint or muscle soreness, or that you are seeking products for athletic recovery.
- Products you purchase, browse, or add to cart. Because our product line includes items marketed for skincare, body care, athletic recovery, and sensitive skin, purchase and browsing data may indirectly indicate a wellness-related interest or concern.
- Information voluntarily provided when entering giveaways or surveys. Where we run a giveaway or survey, you may choose to share information related to your skin type or wellness goals; you are not required to do so to receive our products.
- Inferences drawn from the above. For example, an inference that a customer who purchases Active Cream and Muscle Cream may be interested in athletic recovery content.
We do not collect:
- Biometric data
- Precise geolocation tied to health activity
- Medical diagnoses or treatment records
- Reproductive or sexual health data
- Genetic data
- Information from health care providers
- Information about specific medical conditions beyond what a customer voluntarily mentions in a casual product inquiry

We may collect Consumer Health Data from the following sources:
- Directly from you, when you contact us, place an order, leave a review, fill out a contact form, or interact with us at a farmers market or event
- Automatically, through cookies and similar technologies on artisanthegoat.com (subject to your cookie preferences — see our Privacy Policy)
- From our service providers (such as our e-commerce platform Shopify, our email service provider, and our analytics provider) acting on our behalf
3. Purposes for Which We Collect and Use Consumer Health Data
We collect and use the limited Consumer Health Data described above only for the following purposes:

- To respond to your customer service inquiries, including product recommendations when you ask which Artisan product may suit your concern

We do not sell Consumer Health Data, and we have not in the preceding twelve months sold Consumer Health Data, as the term "sell" is defined under the Washington My Health My Data Act.
5. Your Rights Regarding Consumer Health Data
If you are a Washington resident (or, where applicable, a resident of Nevada or Connecticut), you have the following rights regarding your Consumer Health Data:
- Right to confirm and access. You may request confirmation of whether we are collecting, sharing, or selling your Consumer Health Data, and request to access that data.
- Right to withdraw consent. You may withdraw any consent you previously gave us to collect or share your Consumer Health Data.
- Right to deletion. You may request that we delete your Consumer Health Data, subject to limited exceptions where retention is required by law.
- Right against discrimination. We will not discriminate against you for exercising any of the rights described in this Notice.
- Right to appeal. If we deny your request, you may appeal our decision. If your appeal is denied, you may contact the Washington Attorney General at www.atg.wa.gov.

We may also use limited information (such as a hashed email address) to deliver advertising on platforms like TikTok, Meta (Instagram and Facebook), YouTube, Pinterest, and LinkedIn. Some of this sharing may be considered "sharing" or "selling" for cross-context behavioral advertising under certain state privacy laws. See Section 7 for your rights.
- Talent and modeling partners. Where models appear in our brand content, we may share images and content with the relevant agency under the terms of a talent release.
- Affiliates and creators. If you are a participant in our TikTok Shop or other affiliate program, we may share information with TikTok and applicable payment service providers as described in our TikTok Shop Terms and Conditions.
- Government and law enforcement. We may disclose information when required by law, regulation, legal process, subpoena, court order, or government request.
- Business transfers. In the event of a merger, acquisition, sale of assets, financing, or similar transaction, personal information may be transferred as part of the transaction, subject to confidentiality protections.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make purchases on the Site or create an account. By using the Site, you represent and warrant that you meet this requirement and that you have the legal authority to enter into these Terms.

You and Artisan The Goat agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased from us — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — will be resolved by final and binding individual arbitration, rather than in court, except as provided below.
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted by a single arbitrator. The arbitration will take place by remote electronic means where permitted; if an in-person hearing is required and the parties cannot agree on a location, it will take place in a metropolitan area within 100 miles of Vancouver, Washington. The Federal Arbitration Act (9 U.S.C. §§ 1-16) governs this arbitration agreement.
Class Action Waiver. You and Artisan The Goat agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, consolidated, or private attorney general action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Either party may bring an individual action in small claims court if eligible. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights.
Opt-Out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out by email to hello@artisanthegoat.com with the subject line "Arbitration Opt-Out" within thirty (30) days after first becoming subject to these Terms. Your notice must include your full name, mailing address, and a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms.
If the Class Action Waiver is found to be unenforceable for any reason with respect to a particular claim, then that claim (and only that claim) must be severed and brought in a court of competent jurisdiction in the State of Washington, but the remainder of the arbitration agreement will continue to apply.
17. Governing Law and Venue
These Terms and any dispute between you and Artisan The Goat are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Subject to Section 16, you and Artisan The Goat agree that the state and federal courts located in Clark County, Washington shall have exclusive jurisdiction over any claim that is not subject to arbitration.
18. Termination
We reserve the right to suspend or terminate your access to the Site, or to refuse service, at any time and for any reason, with or without notice. Sections that by their nature should survive termination (including without limitation Sections 7, 8, 13, 14, 15, 16, 17, and 19) will survive any termination of these Terms.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a revised effective date. If we make material changes, we will provide additional notice (such as a banner on the Site or by email to registered customers). Your continued use of the Site after the updated Terms take effect constitutes your acceptance of the updated Terms.
20. Miscellaneous
- Entire agreement. These Terms, together with the other policies linked from the Site footer, constitute the entire agreement between you and Artisan The Goat regarding the Site, superseding any prior agreements.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
- Headings. Headings are for convenience only and do not affect the interpretation of these Terms.

THIS MEANS YOU CANNOT BRING CLAIMS AGAINST ARTISAN THE GOAT IN COURT, AND CONFIRMS YOUR AGREEMENT TO A CLASS ACTION WAIVER IN ARBITRATION. IT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.

1. Introduction
By clicking the "Add Products" button or otherwise participating in the Program, you ("You", "Creator" or "Social Seller") agree to these Artisan The Goat ("We", "Us", "Our", or "Artisan") Open Affiliate Terms and Conditions (the "Artisan Terms") governing Your participation in the Artisan The Goat Open Affiliate Program on TikTok.
2. These Terms
These Artisan Terms are separate from TikTok Shop's Creator Terms of Use ("TikTok Terms"). The TikTok Terms govern Your relationship with TikTok, while these Artisan Terms, in addition to TikTok Terms, govern the relationship between You and Artisan. These Artisan Terms shall take precedence when a conflict of terms arises between topics covered in these Artisan Terms and the TikTok Terms.
YOU HEREBY REPRESENT AND WARRANT THAT YOU ARE LAWFULLY ABLE TO ENTER INTO CONTRACTS, THAT YOU ARE 18 YEARS OF AGE OR OLDER, THAT YOU ARE NOT A MINOR IN YOUR JURISDICTION, THAT YOU ARE NOT AN OWNER OR EMPLOYEE OF ARTISAN THE GOAT OR A MEMBER OF THE FOUNDING FAMILY, AND THAT YOU ARE AND WILL REMAIN IN COMPLIANCE WITH THESE ARTISAN TERMS, INCLUDING THE ARTISAN SOCIAL COMMERCE VALUE CHARTER (BELOW). IF THESE ARTISAN TERMS ARE BEING AGREED TO BY A COMPANY OR OTHER LEGAL ENTITY, THEN THE PERSON AGREEING TO THESE ARTISAN TERMS ON BEHALF OF THAT COMPANY OR ENTITY HEREBY REPRESENTS AND WARRANTS THAT THEY, HE OR SHE IS AUTHORIZED AND LAWFULLY ABLE TO BIND THAT COMPANY OR ENTITY TO THESE ARTISAN TERMS.
If You violate these Artisan Terms or the Artisan Social Commerce Value Charter, in addition to any other rights or remedies available to Us, We reserve the right to direct TikTok to permanently (to the extent permitted by applicable law) cease payment of (and You agree You will not be eligible to receive) any commission income attributable to this Program otherwise payable to You under these Artisan Terms and the TikTok Terms, whether or not directly related to such violation without notice and without prejudice to any right of Artisan to recover damages over this amount. By participating in this Program, You agree that You must promptly provide Us with any information that We request to verify Your compliance with these Artisan Terms.
3. Artisan The Goat Social Commerce Value Charter
By participating in the Program, you agree to the Social Sellers' commitments of the Artisan The Goat Social Commerce Value Charter, set forth below.

- You share with us the same ethical principles and values of integrity, respect, courage, and transparency, and commit to communicating authentically, and to sharing creative, engaging, and valuable content, in line with these values and principles. You do not mislead our customers to believe in unachievable effects of our products, through any kind of techniques. You do not make medical claims about our skincare, body care, or wellness products. You are free to share honest opinions about our products and brand while refraining from posting defamatory or untruthful content.
- You commit to not posting, and to not having previously posted, content that is at odds with our values of respect, tolerance, and inclusion. In particular, partners will not share views or engage in behavior which could be interpreted as racism, antisemitism, homophobia, misogyny, intolerance toward any religion, violence, hateful content, bullying or aggressiveness toward others, pornography, or any criminal activity. As a family-owned company, we ask that all content remain family-friendly, with no profanity.
- You will always respect the freedom of choice of the audience and will not force a purchase on a non-consenting consumer in any way.
- Our partners commit to respecting the terms of the agreement including expectations, objectives, and timelines, and to refrain from disclosing confidential information about our brand and products to any third party, or disparaging our products or ingredients. In particular, You agree not to make negative statements about ingredients used in Artisan formulations, including but not limited to cetearyl alcohol, phenoxyethanol, stearic acid, sodium hyaluronate, chlorelleth-20, benzoic acid, and dehydroacetic acid, all of which are intentional, beneficial choices in our formulas.
- You are transparent about the nature of your relationships with us by fully disclosing your commercial interests to your audience, in accordance with the guidelines of your local advertising standards (#ad, #BrandPartner, #SponsoredBy, #ArtisanPartner, etc.).
- You respect local regulations related to your activity and are duly registered with the relevant local social security, tax, and administrative authorities.
- You will respect all image and intellectual property rights of third parties (including trademarks, designs, copyrights, moral rights, and neighboring rights), as well as all consumers' rights to data privacy. You will obtain all necessary authorizations from rights owners (including models, photographers, music publishers, and record labels) before using any third party's image or works (including music) in any content, and ensure the prompt deletion of any infringing content.
- You will act and communicate respectfully with your audience, peers, and our small family team during all interactions.
4. Services
Once You are an eligible and approved creator by TikTok under the TikTok Terms, You can access and use TikTok E-commerce Creator Center where You will find opportunities to be selected by Us to promote Our selected products through Your TikTok social media account by creating content, text, photographs, user-generated content, and videos (including live-streamed and recorded) that incorporates pre-cleared music from TikTok's Commercial Audio Library (hereinafter, "Your Content") in order to be eligible to earn a fixed commission set by Us if Your Content generates sales through TikTok's shop (the "TikTok Shop") for Us (hereinafter, the "Services"). For the avoidance of doubt, any music you choose to include in Your Content must be pre-cleared music from TikTok's Commercial Music Audio Library, and no other music is permitted in Your Content. You shall perform Your Services and provide all of Your Content hereunder in accordance with any general creative, editorial, aesthetic, and technical requirements, as well as design features and other guidelines and specifications communicated by Us prior to the social media post(s) of Your Content. You shall also comply with any deadlines given by Us to provide Services. Any amounts payable to You hereunder will not be paid by Us directly, but rather will be paid through TikTok's payment service providers (hereinafter, "Third Party PSPs"), which may include payment processors such as Hyperwallet, and which will be subject to such Third Party PSP's Terms of Service and Privacy Policies. For the avoidance of doubt, owners, employees, and immediate family members of the founding family of Artisan The Goat shall not be eligible for any commissions under these Artisan Terms.
5. Your Content
You grant Us, and our current and future affiliates ("Affiliates"), a worldwide, royalty-free, non-exclusive, sublicensable, transferable, assignable, perpetual right and license, in any and all formats and media now known or hereafter devised, including in paid media, to reproduce, publicly perform, publicly display, distribute, create derivative works from, combine with other materials, digitize, publish, exhibit, edit, modify, alter, distort, reformat, sample, loop, rescore, remove third-party content from, advertise, and otherwise use and exploit Your Content, in whole or in part, or portions thereof, together or separately with your name, nickname, moniker, social media handle, social media user name, image, likeness, photograph, profile picture, statements, facial expressions, voice, quotes, caption, Your Content title(s), biographical information, and any other identifying information of You ("Your Information"). The foregoing license shall be in addition to, and shall in no way limit, any license you may grant Us in Shop Ads. You retain all ownership rights in Your Content and Your Information. You acknowledge and agree that We retain all rights, title, and interest in and to all advertising and marketing materials which We develop, create, or otherwise own, other than the rights in Your Content and Your Information. You hereby waive the right to inspect or approve any use of, or changes to, Your Content and any of Your Information incorporated therein.
Except for materials provided to You by Us, if any, You acknowledge and agree that You shall be solely responsible for clearing any and all third-party materials contained in Your Content, including, without limitation, any and all trademarks (including, without limitation, logos, word marks, stylized marks, and audio), copyrightable content (including, without limitation, artistic works such as photos, videos, clips, artwork, sketches, drawings, sculptures, or portions of any of the foregoing; musical works including music, songs, compositions, scores, performances, sounds, soundscapes, sound effects, loops, samples, or portions of any of the foregoing; and literary works including books, manuscripts, poetry, compilations, reports, speeches, online works, advertising copy, and games or portions of any of the foregoing), personal/publicity rights (including, without limitation, rights to an individual's name, image, likeness, voice and statements, social media handle, city and state of residence, biographical information, or portions of any of the foregoing), and any other materials protected by intellectual property or privacy laws ("Intellectual Property Rights"). Upon Our request, You agree to provide all necessary consents, licenses, waivers, non-disclosure agreements, and releases for Our use of Your Content in written form, and in a form acceptable to Us, to be determined in Our sole discretion. For the avoidance of doubt, You acknowledge and agree that only sounds from TikTok's Commercial Audio Library are permitted in Your Content, and You hereby agree not to include any other music, songs, compositions, scores, performances, sounds, soundscapes, sound effects, loops, samples, or portions of any of the foregoing in Your Content.
6. Representations and Warranties
You represent and warrant that: (i) the person appearing in Your Content is You, and that no other person is appearing or featured in Your Content; (ii) all contents and elements of Your Content are original to You, and You own all the rights in Your Content, or, if You do not own any element(s) of Your Content, You have a license and/or have otherwise obtained all necessary rights to use all material and contents/elements in Your Content that are the subject of third-party rights, including all Intellectual Property Rights, and You have the right to sublicense these rights to Us; (iii) Your Content, and the contents/elements contained therein, does not violate any law; (iv) You are not limited or restricted in granting any right granted herein by any obligation to any other person, firm, or corporation, and You have not entered into, and shall not enter into, any agreement that would interfere with the rights and obligations granted in these Artisan Terms; (v) Your Content shall be in compliance with the FTC's Guides Concerning the Use of Endorsements and Testimonials, including clearly and conspicuously disclosing Your material connection to Us, and You shall follow any additional guidelines that may be provided by Artisan The Goat as part of any campaign brief for products sold through TikTok Shop; (vi) Your Content only contains your honest and truthful opinions about Our products and brand, and You will not endorse products that You have not used; (vii) Your Content will show the actual product You are endorsing in Your Content; (viii) You will only make truthful statements that are not misleading about the performance and attributes of Our products. You will not make medical or therapeutic claims about Our skincare, body care, soap, lip balm, or candle products, including but not limited to claims that any product treats, cures, prevents, or diagnoses any disease, skin condition, injury, or medical condition; (ix) if You have received a product sample, You will verbally and visually disclose that receipt of that free product from Us, including with "Gifted by Artisan The Goat" as a text overlay in a clear and conspicuous manner or as otherwise directed by Us; (x) You will not mention any competing products or any retailers in Your Content; (xi) You will not use artificial intelligence, including generative artificial intelligence, to produce Your Content unless preapproved by Us; (xii) Your Content shall not contain any disparaging remarks about Artisan The Goat, our family, our farm, our animals, our ingredients, or our competitors, and shall not be hateful, intolerant, inappropriate, or reference any illegal drugs; and (xiii) Your Content shall remain family-friendly, with no profanity, consistent with the family-friendly character of our brand.
Notwithstanding anything to the contrary set forth in these Artisan Terms and without limiting any other of Our rights, You acknowledge and agree that (i) We shall have no obligation to remove, take down, hide, or otherwise disable public access to any of Your Content posted to social media by Us; (ii) We shall not be liable to You to monitor social media or other online or offline media for any third-party use of Your Content, once such content is made publicly available online; and (iii) We shall have no obligation to remove, take down, hide, or disable any such third-party use. For the avoidance of doubt, You acknowledge and agree that We shall have no liability for, and shall have no obligation to pay compensation of any kind for, any third-party use of Your Content. Nothing in these Artisan Terms shall obligate Us to sue or take any other action against any of Our wholesalers, retailers, distributors, or other third parties using Your Content, whether such use was authorized or unauthorized.
7. Commission
You must comply with these Artisan Terms to participate in the Program and receive commission income. However, We do not make any representation, warranty, or covenant regarding the amount of commission income You can expect at any time in connection with the Program, and We will not be liable for any actions You undertake based on Your expectations.
8. Right to Monitor
We reserve the right to conduct a review of the materials You post on any social media platform and any public data available about You. This review involves Us looking at Your social media content and public profile to see if Your values match Artisan's values as set forth in the Artisan Social Commerce Value Charter above. We reserve the right at all times to require You to edit, take down, or otherwise remove Your social media post(s) in Our sole discretion. You shall immediately modify, remove, or discontinue, as We shall determine in Our sole discretion, any content about Us, and any other references to Us, upon Our notification to You.
9. Artisan The Goat Trademarks
If We provide You with trademarks, products, or any other material owned by Us ("Our Materials"), You agree to limit Your use of Our Materials to the provision of the Services. In the event that We provide any of Our Materials to You, You agree to use those products only in connection with the Services provided herein or for Your own personal use. You will not sell Our Materials to any third parties, nor use Our Materials as promotional items in giveaways, contests, or sweepstakes, without Our prior written approval. The "Artisan The Goat" name and logo, our goat imagery, our farm imagery, and product photography are protected marks and assets of Artisan The Goat.
10. Term and Termination
We may terminate or suspend Your participation in the Program at any time for any reason, including but not limited to any of the following: (a) You are in breach of these Artisan Terms; (b) We believe that We may face potential claims or liability in connection with Your participation in the Program; (c) We believe that Our brand or reputation may be tarnished by You or in connection with Your participation in the Program; (d) Your participation in the Program has been used for deceptive, fraudulent, or illegal activity; or (e) We have terminated or intend to terminate the Program or any part thereof as it pertains to You.
11. Privacy
We have developed a Privacy Policy to inform You of Our practices with respect to the collection, use, disclosure, and protection of personal information. You can find this information in our Privacy Policy. By participating in this Program, you acknowledge you have read and understood Our Privacy Policy.
12. Confidentiality
You will not disclose to any third party or otherwise utilize any confidential or proprietary information obtained pursuant to these Artisan Terms regarding Us, Our products, services, formulations, strategies, or activities. For purposes of these Artisan Terms, the term "Confidential Information" shall be deemed to include all information and materials furnished by or on behalf of Us to You and/or otherwise arising from and/or in connection with the Program.
13. Disclaimers
Neither We nor any of Our Affiliates or licensors make any representation or warranty of any kind, whether express, implied, statutory, or otherwise, with respect to the Program, including any implied warranties of title, merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement, and any warranties arising out of any law, custom, course of dealing, performance, or trade usage. Further, neither We nor any of Our Affiliates or licensors will be responsible for any compensation, reimbursement, or damages arising in connection with (x) any loss of prospective commissions, profits or revenue, anticipated sales, goodwill, or other benefits; (y) any investments, expenditures, or commitments by You in connection with Your participation in the Program; or (z) any termination or suspension of Your participation in the Program.
14. Limitations on Liability
Neither We nor any of Our Affiliates or licensors will be liable for indirect, incidental, special, consequential, or exemplary damages, or any loss of revenue, profits, goodwill, use, or data arising in connection with the Program, even if We have been advised of the possibility of those damages. Further, Our aggregate liability arising in connection with the Program will not exceed the total commission income paid or payable to You under these Artisan Terms in the twelve (12) months immediately preceding the date on which the event giving rise to the most recent claim of liability occurred. You hereby waive any right or remedy in equity, including the right to seek specific performance, injunctive, or other equitable relief in connection with these Artisan Terms, the Program, or any of Your Content produced as part of Your participation in the Artisan The Goat Affiliate Program on TikTok. Nothing in this paragraph will operate to limit liabilities that cannot be limited under applicable law.
15. Indemnification
To the maximum extent permitted by applicable law, We will have no liability for any matter directly or indirectly relating to the creation, maintenance, or operation of Your TikTok channel(s) (including Your use of any TikTok service offering) or Your violation of these Artisan Terms, and You agree to defend, indemnify, and hold Us and Our respective Affiliates and licensors, and Our and their respective employees, officers, directors, family members, and representatives, harmless from and against all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) relating to (a) Your participation in the Program; (b) Your TikTok channel(s) or any materials that appear on Your TikTok channel(s), including the combination of Your TikTok channel(s) or those materials with other applications, content, or processes; (c) the use, development, design, manufacture, production, advertising, promotion, or marketing of Your TikTok channel or any materials that appear on or within Your TikTok channel; (d) Your use of any TikTok service offering or Your participation in the Program, whether or not such use is authorized by or violates these Artisan Terms or any TikTok policies or terms or applicable law; (e) Your violation of any term or condition of these Artisan Terms (including the Artisan Social Commerce Value Charter) or any TikTok policies or terms; (f) Your taxes and duties or the collection, payment, or failure to collect or pay Your taxes or duties, or the failure to meet tax registration obligations or duties; or (g) Your or Your employees' or contractors' negligence or willful misconduct.
16. Independent Contractors
You and We are independent contractors, and nothing in these Artisan Terms will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between You and Us or Our respective Affiliates, nor shall You represent to any third party that any of the foregoing relationships exists. You will have no authority to make or accept any offers or representations on Our or Our Affiliates' behalf. If You authorize, assist, encourage, or facilitate another person or entity to take any action related to the subject matter of these Artisan Terms, You will be deemed to have taken the action Yourself.
17. Mutual Arbitration
The parties hereto shall use good faith efforts to settle any Dispute (as defined below). To this effect, the parties shall consult and negotiate with one another in good faith, in an attempt to reach a just and equitable solution satisfactory to all parties. You and Artisan mutually agree to resolve any Dispute exclusively through final and binding arbitration pursuant to the Commercial Arbitration Rules of the American Arbitration Association ("AAA Rules") as then in effect (currently available at www.adr.org), instead of a court or jury trial. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). For clarity, "Disputes" subject to this agreement to arbitrate include any dispute, claim, question, or disagreement arising from or relating to these Artisan Terms or the breach thereof, in connection with the Program, or arising from any arrangement under these Artisan Terms (whether between You and Us or You and TikTok), including Your classification as an independent contractor, Your provision of services, the payments received by You for providing services to Artisan, the termination of Your participation in the Program, and all other aspects of Your relationship with Artisan, past, present, or future, whether arising under federal, state, or local statutory and/or common law. However, this agreement to arbitrate does not apply to litigation between You and Artisan pending in a state or federal court as of the date of Your receipt of these Artisan Terms, nor does it apply to any claim that may not be arbitrated as provided by an Act of Congress or a lawful, enforceable Executive Order.
If either party wishes to initiate arbitration, the initiating party must notify the other party in writing via certified mail, return receipt requested, within the applicable statute of limitations period. This demand for arbitration must include (1) the name and address of the party seeking arbitration, (2) a statement of the legal and factual basis of the claim, and (3) a description of the remedy sought. Any demand for arbitration shall be delivered to the address indicated in the notice terms of these Artisan Terms, unless that address has been updated in writing.
18. Class Action Waiver
You and Artisan mutually agree that, by entering into this agreement, We waive Our right to have any Dispute brought, heard, or arbitrated against either of us or Our suppliers, licensors, or service providers (including TikTok) as a class action, collective action, and/or representative action, and an arbitrator shall not have any authority to hear or arbitrate any class, collective, or representative action. Notwithstanding any other clause contained in this agreement or the AAA Rules, as set forth below, any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator. In any case in which (1) the Dispute is filed as a class, collective, representative, or private attorney general action, and (2) there is a final judicial determination that all or part of the Class Action Waiver is unenforceable, the class, collective, representative, and/or private attorney general action to that extent must be litigated in a civil court of competent jurisdiction, but the portion of the Class Action Waiver that is enforceable shall be enforced in arbitration. This agreement does not prevent the filing of charges with a government agency or participation in any investigation or proceeding conducted by a government agency.
19. Arbitration Proceeding
Any arbitration hereunder shall be governed by the AAA Rules, subject to the following:
- The arbitration shall be heard by one arbitrator selected in accordance with the AAA Rules. The arbitrator shall be an attorney with experience in the law underlying the dispute or a retired judge.
- To the extent permitted under AAA Rules, the arbitration shall be conducted via remote electronic means. In the event the arbitrator determines an in-person hearing is required, if the parties cannot otherwise agree on a location for the arbitration, the arbitration shall take place in a metropolitan area within 100 miles of Vancouver, Washington.
- Each party will pay the fees for its own attorneys, subject to any remedies to which that party may later be entitled under applicable law. However, in all cases where required by law, Artisan will pay the arbitrator's and arbitration fees. If under applicable law Artisan is not required to pay all of the arbitrator's and/or arbitration fees, such fee(s) will be apportioned between the parties in accordance with said applicable law, and any disputes in that regard will be resolved by the arbitrator.
- The arbitrator may issue orders (including subpoenas to third parties) allowing the parties to conduct discovery sufficient to allow each party to prepare its claims and/or defenses, taking into consideration that arbitration is designed to be a speedy and efficient method for resolving disputes. Depositions will generally be limited to no more than two depositions per party.
- Except as provided in the Class Action Waiver, the arbitrator may award all remedies to which a party is entitled under applicable law and which would otherwise be available in a court of law, but shall not be empowered to award any remedies that would not have been available in a court of law for the claims presented in arbitration. The arbitrator shall apply the state or federal substantive law, or both, as is applicable.
- The arbitrator may hear motions to dismiss and/or motions for summary judgment, and will apply the standards of the Federal Rules of Civil Procedure governing such motions.
- If a party seeks injunctive relief that would significantly impact other participants in the Program as reasonably determined by either party, the parties agree that, upon either's election, such arbitration will not proceed on an individual basis but will be handled by a panel of three (3) arbitrators. Each party shall select one arbitrator, and the two party-selected arbitrators shall select the third, who shall serve as chair of the arbitral panel. That chairperson shall be a retired judge or an attorney licensed to practice law and with experience arbitrating or mediating disputes. In the event of disagreement as to whether the threshold for a three-arbitrator panel has been met, the sole arbitrator appointed in accordance with this section shall make that determination.
- The arbitrator's decision or award shall be in writing with findings of fact and conclusions of law. Judgment may be entered on the arbitrator's decision or award in any court having jurisdiction.
- Nothing herein is intended to or shall preclude You or Artisan from filing a complaint and/or charge with any appropriate federal, state, or local government agency and/or cooperating with said agency in its investigation. Nonetheless, You and Artisan acknowledge that, to the fullest extent permitted by law, You and We shall not be entitled to receive any private relief, recovery, or monies in connection with any governmental complaint or charge, without regard as to who brought said complaint or charge. All monetary relief will only be available through arbitration.
- Either You or Artisan may bring an action in a court of competent jurisdiction to compel arbitration under this agreement, to enforce an arbitration award, or to review an arbitration award. In an action to review an award, the standard of review applied will be the same as that applied by an appellate court reviewing the decision of a trial court sitting without a jury, without any special deference to the arbitrator.
- You and Artisan expressly waive trial by jury for all claims covered by this Agreement. All other rights, remedies, exhaustion requirements, statutes of limitation, and defenses applicable to claims asserted in a court of law will apply in the arbitration. You and Artisan agree that arbitration as explained herein provides a fair and adequate mechanism for enforcing the parties' statutory rights.
- You agree and acknowledge that entering into this arbitration agreement does not change Your status as an independent contractor in fact and in law, and that You are not an employee of Artisan The Goat notwithstanding this arbitration agreement.
- Except as and to the extent otherwise may be required by law, the arbitration proceeding and any award shall be confidential.
This arbitration agreement is the full and complete agreement relating to the formal resolution of disputes covered by this arbitration agreement. In the event any portion of this arbitration agreement is deemed unenforceable, the remainder of this arbitration agreement will be enforceable. You have the right to consult with counsel of Your choice concerning this arbitration agreement.
20. Applicable Law
These Artisan Terms and the contractual relationship between You and Artisan The Goat shall be governed by the laws of the State of Washington, U.S.A., without regard to its conflict of laws principles.
21. Modifications
We reserve the right to modify any of the terms and conditions contained in these Artisan Terms at any time and in Our sole discretion by posting a change notice or revised Artisan Terms. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING THE EFFECTIVE DATE OF SUCH CHANGE WILL CONSTITUTE YOUR ACCEPTANCE OF THE MODIFICATIONS. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE YOUR PARTICIPATION IN THE PROGRAM.

These User Generated Content Permission Terms ("UGC Terms") explain how Artisan The Goat ("We," "Us," or "Our") may use content that you share publicly about our products or our family farm, and what permissions you grant us when you do.
These UGC Terms apply when you:
- Tag us on a social media platform (such as TikTok, Instagram, YouTube, Facebook, Pinterest, or LinkedIn) using @artisanthegoat or a similar handle
- Use a hashtag we sponsor, encourage, or promote (such as #ArtisanTheGoat, #ArtisanFarm, or any branded hashtag we create for a campaign)
- Submit content directly to us by email, contact form, or other channel — including photos, videos, written reviews, product testimonials, or social media posts
- Respond to a request from us asking for permission to share your content
- Submit a product review on our Site or on a third-party review platform we use
- Participate in a giveaway, contest, or campaign we run
By doing any of the above, you agree to these UGC Terms.
1. What Counts as "User Generated Content"
"User Generated Content" or "UGC" means any content you create or share that relates to Artisan The Goat, including but not limited to:
- Photographs and videos featuring our products, our farm, our goats, our family, or our branding
- Captions, comments, descriptions, hashtags, and written reviews
- Audio recordings or voiceovers
- Stories, reels, livestreams, shorts, and other short-form video
- Pinterest pins and boards
- LinkedIn posts and articles
- Blog posts, podcast episodes, and similar long-form content
- Submissions to a giveaway, contest, or content campaign
2. Your Representations
By submitting UGC to us, or by tagging us or using a branded hashtag, you represent and warrant that:
- You are at least 18 years old and have the legal authority to enter into these UGC Terms.
- You created the UGC yourself, or you have all necessary rights and permissions to share it and to grant us the license in Section 3.
- The UGC is your own honest opinion and reflects your genuine experience with our products. If you received a free product, sample, or other compensation from us, you have clearly disclosed that relationship in your UGC, in accordance with the FTC's Guides Concerning the Use of Endorsements and Testimonials (#ad, #gifted, #ArtisanPartner, etc.).
- Anyone who appears in the UGC has given their permission to be featured and for the UGC to be used as described in these UGC Terms. If any minor (anyone under 18) appears in the UGC, you have the consent of their parent or legal guardian.
- The UGC does not contain anyone else's intellectual property — including third-party music, brand logos, copyrighted images, or other protected content — unless you have a license to use it and to grant us the rights in these UGC Terms.
- The UGC is family-friendly. It does not contain profanity, nudity, sexually explicit content, graphic violence, hateful or discriminatory content, illegal activity, or anything else that conflicts with our values as a family-owned company.
- The UGC does not make medical claims about our products. Our products are not intended to diagnose, treat, cure, or prevent any disease, and your UGC must not suggest otherwise.
- The UGC does not disparage our brand, our family, our farm, our animals, our ingredients (including cetearyl alcohol, phenoxyethanol, stearic acid, sodium hyaluronate, chlorelleth-20, benzoic acid, dehydroacetic acid, and any other intentional ingredient in our formulations), or any third party.
- The UGC complies with all applicable laws, including advertising disclosure laws and the platform terms of any social media service where it is posted.
3. License You Grant Us
You retain ownership of your UGC. However, by submitting UGC to us or by tagging us or using a branded hashtag, you grant Artisan The Goat (and our current and future affiliates, successors, assignees, agents, contractors, and sublicensees) a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, sublicensable, transferable, assignable license to:
- Use, reproduce, distribute, publicly display, publicly perform, modify, edit, adapt, translate, create derivative works from, combine with other content, and otherwise exploit the UGC
- Use the UGC in any and all formats and media now known or hereafter developed, including our website, social media platforms, email and SMS marketing, paid digital advertising, print materials, packaging, in-store displays, farmers market signage, presentations, and press materials
- Use, in connection with the UGC, your name, social media handle, profile photo, likeness, voice, quotes, biographical information you have made public, and the text of your post or caption ("Your Identifying Information")
- Crop, resize, color-correct, add text overlays, add music or voiceover from licensed sources, or otherwise edit the UGC to fit a given format or campaign
This license is in addition to (and does not replace) any license you may have already granted to the social media platform on which you originally posted the UGC. You waive any right to inspect or approve our use of the UGC, although we will of course try to use it in a way that reflects well on you and on Artisan The Goat.
4. No Obligation to Use
We may, but are not required to, use any UGC you submit, tag us in, or share. We may decline to use UGC, or stop using UGC we have previously used, at any time and for any reason, in our sole discretion.
5. Compensation
Unless we have agreed in writing otherwise (for example, in a paid creator partnership or affiliate agreement), you are not entitled to any compensation, payment, royalty, credit, free product, or other consideration in exchange for our use of your UGC. Your UGC is shared as a contribution to a community of customers who love our products and our farm.
6. Attribution
When we use your UGC, we will usually credit you — for example, by tagging your social media handle or naming you in a caption. However, we are not required to do so, and the appearance or absence of attribution does not change the license you have granted us.
7. Removal Requests
If you would like us to stop using a specific piece of UGC, please contact us at hello@artisanthegoat.com with the subject line "UGC Removal Request" and include enough detail for us to identify the content (links, screenshots, or descriptions).
We will use reasonable efforts to remove the UGC from content under our direct control within a reasonable time. However, please understand:
- We cannot recall UGC that has already been used in printed materials, packaging, or distributed advertising
- We cannot guarantee removal from third-party platforms or websites we do not control
- We are not required to remove UGC that has been incorporated into a derivative work, where removal is no longer reasonably practical
- We are not required to take action against third parties who have re-posted or re-shared our content containing your UGC
The license you granted under Section 3 survives any removal request to the extent reasonably necessary.
8. Reviews
Product reviews submitted on our Site or through a review platform we use are covered by these UGC Terms. We may publish, decline to publish, or moderate reviews in accordance with applicable law and platform rules. We do not edit the substance of reviews to misrepresent customer experiences, though we may make minor edits for length, clarity, profanity, or to remove personally identifying information about third parties.
9. Influencer, Affiliate, and Creator Partnerships
If you participate in a formal partnership with us — for example, a paid collaboration, an affiliate arrangement, a TikTok Shop creator program, or a gifted product campaign — additional terms (such as our TikTok Shop Terms and Conditions or a separate written agreement) will apply alongside these UGC Terms. Where the two conflict, the more specific terms control as to the subject they address.
10. Indemnification
You agree to defend, indemnify, and hold harmless Artisan The Goat, its owners, family members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your breach of any representation, warranty, or obligation in these UGC Terms
- Our use of UGC you submitted, tagged us in, or shared, as permitted by these UGC Terms
- Any claim that your UGC infringes the intellectual property rights, privacy rights, publicity rights, or other rights of any third party
11. No Endorsement of Your UGC
Our use of your UGC does not mean that we endorse, verify, or vouch for the views or statements expressed in it. UGC reflects the views and experiences of individual customers and creators. We are not responsible for the accuracy or completeness of any UGC.
12. Privacy
Our use of any personal information associated with UGC is governed by our Privacy Policy. If you are a Washington State resident, please also see our Consumer Health Data Notice.
13. Modifications to These Terms
We may update these UGC Terms from time to time. When we do, we will post the updated UGC Terms on this page with a revised effective date. The version of these UGC Terms that applies to a given piece of UGC is the version in effect at the time you submitted, tagged us in, or shared that UGC.
14. Governing Law and Disputes
These UGC Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any dispute arising out of or related to these UGC Terms is subject to the arbitration agreement and class action waiver in our Terms of Use, which are incorporated here by reference.
